REGISTRATION/SUBSCRIPTIONS/MEMBERSHIPS
Access to certain areas of this website, application or service is restricted. In order to access Somalitoons, you must register or subscribe to create an account (“Account”). During the registration process, you will be required to provide detailed information and you will establish a password. You agree to provide accurate, current and complete information during the registration process and to keep uptodate such information to keep it accurate, current and complete. Provider reserves the right to suspend or cancel Your Account if any information provided during the registration process or thereafter proves to be inaccurate, not current or incomplete. You are responsible for safeguarding Your password and devices with which one can access the website, application or service. You agree not to disclose Your password to any third party and to take full responsibility for any activities or actions under Your Account, whether or not You have authorized such activities or actions. You must immediately notify Provider of any unauthorized use of Your Account.
Somalitoons reserves the right to ban or restrict access to [other] areas of this website, or indeed this entire website, at [Somalitoons] discretion. Incase Somaltioons provides you with a user ID and password to enable you to access restricted areas of this website or other content or services, you must ensure that the user ID and password are kept confidential. Somalitoons can disable your user ID and password in Somalitoons sole discretion without notice or explanation.
FREE TRIALS
Upon registration to use Somalitoons, we may provide a restricted use of the site with a variable duration. Once you select your first clip to watch or listen to, you will be required to give your payment card information to receive your free trial of the site. You will not be charged until after the free trial ends. THE RESTRICTIONS OF THE FREE TRIAL ARE DETERMINED SOLELY AT THE DISCRETION OF SOMALITOONS AND MAY BE MODIFIED AT ANY TIME. THE FREE TRIAL IS PROVIDED ONCE AND ONLY UPON YOUR FIRST REGISTRATION AT THE SITE FOR A SINGLE PERIOD OF TIME. THE FREE TRIAL IS NOT PROVIDED UPON SUBSEQUENT REGISTRATION BY CUSTOMER OR CUSTOMER’S AGENTS OR AFFILIATES UNLESS DECIDED SO BY THE PROVIDER.
TERRITORIES
Somalitoons is available currently only in these territories: Somalia, Ethiopia, Kenya, Djibouti, Yemen, USA, UK, Sweden, Canada, Norway, Netherlands, Germany, Denmark, Finland, Australia, UAE, Saudi Arabia. Unfortunately if your country of residence is not mentioned above we cannot provide you with our full service currently. Available territories may be subject to change. It is your responsibility to check the availability of the service in your territory before accessing our website, application or services.
TERMS OF THE SERVICE
All fees and charges are quoted and billed in Euros unless otherwise noted. Somalitoons uses an automated payment processing system and only accepts credit card, debit card or PayPal payments at this time. All Subscribers are required to maintain valid payment information on file for the processing of any applicable service fees. At its sole discretion, Somalitoons may utilise credit card issuer-approved services, such as VISA Account Updater and MasterCard Automatic Billing Updater, to acquire updated payment information for the purpose of processing outstanding payments that are on your account.
Upon completion of Somalitoons’ Free Trial, your card will be automatically charged either a monthly or annual fee depending on your subscription plan.
At the end of the Initial Term, this Agreement (monthly and annual) will also automatically renew on the day following the last day of the Initial Term and will automatically renew thereafter on the first day of each renewal period as specified by the Subscription Plan, unless either party provides to the other written or electronic notice of termination in accordance with the terms of this Agreement. Either of the parties may terminate this Agreement at any time during the Free Trial and after the free trial at any time.
There is no refund for a paid term of an ongoing subscription plan. Somalitoons may, but will not be required to, provide refunds to subscribers where: Somalitoons reasonably believes that the subscriber was unable to stream the Program in a manner consistent with the purchase terms.
LIMITATIONS TO OUR LIABILITY
The Service is provided on the basis of an "as is" and "as available" and the use of the Service is at your own risk. Somalitoons makes no representations or warranties, either expressed or implied, with respect to the Service, or any service or information provided through the Service. Somalitoons is not responsible for any damages, injury or economic loss arising from the use of the content or Service provided by Somalitoons.
SITUATION OF FORCE MAJEURE
Somalitoons will not be liable for any delay, interruption or failure in the provisioning of services if caused by acts of Allah, declared or undeclared war, fire, flood, storm, slide, earthquake, power failure, the inability to obtain equipment, supplies or other facilities that are not caused by a failure to pay, labor disputes, or other similar events beyond our control that may prevent or delay service provisioning.
VIOLATIONS OF THESE TERMS AND CONDITIONS
Without prejudice to Somalitoons’ other rights under these terms and conditions, if you violate these terms and conditions in any way, Somalitoons may take such action as Somalitoons sees appropriate to deal with the violation, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.
